EEOC Update: Commission Votes to Postpone Action on ADAAA Regulations

American Association of People with Disabilities (AAPD) staff attended the meeting of the Equal Employment Opportunity Commission that was scheduled to discuss new regulations implementing the Americans with Disabilities Act Amendments Act.
EEOC Chair Naomi Churchill Earp, citing concerns that had been raised by members of the disability community about the Commision issuing an "Interim Final Rule" that would take effect without any opportunity for our community to review and comment on them, announced yesterday that she had decided to follow a more traditional "Notice of Proposed Rulemaking" process where we would have an opportunity to comment on the proposed regulations before they take effect.
The Commission then discussed whether the proposed regulations were ready to be circulated for comment, and two of the four Commissioners (Stuart Ishimaru and Christine Griffin) said that they believe the proposed regulations need more work and voted against issuing them as a proposed rule at this time.
